Employers, except for a limited number of entities, do not ask job applicants about arrests or detentions that did not result in conviction; convictions for which the record has been ordered sealed or expunged; misdemeanor convictions that were dismissed by expungement; or information concerning a referral to, and participation in, any pretrial or post-trial diversion program.
